住宅建设用地使用权届满后可以续期吗 ■方高宇杨永贵前不久，我在驻地购买了一套二手家庭住房。拿到房子的不动产权证书后，我发现这套房屋的国有土地使用权期限仅剩下30多年。请问，这会影响房子的使用吗？使用权到期后，我该怎么办？ ——某部军士小王商品房不动产权证书上有明确的土地使用权期限。许多官兵在购房时都心存疑虑，到期后房屋所有权是否还是我的？土地使用权期限是否可以续期？如果可以，续期手续又该如何办理？民法典明确规定，住宅建设用地使用权期限届满的，自动续期。这一规定其实具有三层法律含义：一是程序上的当然性。面对这种情况，在使用权期限届满时，小王无须向行政机关提出申请，无须办理审批手续，亦无须提供任何证明材料。法律从根本上免除了小王的程序负担，也杜绝了因未申请或申请未获批准而丧失权利的风险；二是权利上的延续性。土地使用权的期限届满并不意味着权利的终结，而是新一阶段权利存续的起算点。法律以明文形式确认续期的必然性，保障了住宅建设用地使用权在期限届满后得以自然延续；三是效力上的强制性。该法条属于强制性法律规范，行政机关不得以规范性文件的形式加以限制或变通，任何单位和个人在商品房买卖等民事活动中也不得以协议方式排除或变更。从物权法首次确立“自动续期”原则，到民法典对该原则的完整承继，并进一步完善，体现了法律对居住权益的保护力度不断增强。对于广大官兵而言，在购房时应提前认真了解相关法律规定，尤其应当注意以下几个方面：首先，要准确掌握权属信息。查阅本人持有的不动产权证书，关注“权利类型”“用途”“使用期限”等栏目记载的内容，清楚了解不动产的权利性质和土地使用权剩余年限等信息，做到权属清晰、心中有数；其次，要理性看待期限届满。住宅建设用地使用权期限届满后依法自动续期，因此无须为此产生顾虑，更不能轻信社会上流传的不实信息。法律已经为居住权益提供了明确保障，期限届满不影响房屋的正常使用、交易和继承；再次，认真区分不同类型用地。自动续期制度仅适用于住宅建设用地，对于非住宅建设用地使用权届满后的续期，则依照相关规定办理。
